HUF Registration in brief

A Hindu Undivided Family (HUF) is a family unit treated as a separate taxpayer under the Income-tax Act. It is created by a declaration or HUF deed with a karta and coparceners, and it needs its own PAN and bank account. HUF income is taxed separately, which can add a basic exemption and slab benefit for the family.

An HUF exists under Hindu law by birth and does not require registration with a government registry. Practically, however, you need a documented HUF deed, a PAN in the HUF’s name and a bank account before it can invest, own property or run a business. These documents prove the existence and composition of the HUF to banks and the income-tax department.

We prepare the HUF deed with details of the karta, members, initial property or gift received and the purpose of the HUF. We then apply for the HUF PAN and help you open an HUF bank account. Gifts to an HUF from relatives are not taxed in the HUF’s hands, but gifts from non-members and income from such property can attract clubbing rules, so we advise on structuring carefully.

If the HUF runs a business or crosses the GST threshold, we also arrange GST registration and returns in the HUF’s name, with the karta as the authorised signatory.

Documents

Documents and information required

  • List of coparceners and members with relationship

  • Gift deed or declaration of initial assets (if applicable)

Avoid errors

Common mistakes we help you avoid

  • Mixing personal and HUF funds in the same account.
  • Failing to document the gift or source of HUF property.
  • Not filing ITR for the HUF despite income above the exemption limit.
  • Transferring personal income-producing assets to HUF without considering clubbing rules.
  • Using the karta’s PAN instead of HUF PAN for investments.
Ongoing compliance

How we help you stay compliant after HUF Registration

Every year we help the HUF file its ITR, maintain separate books and reconcile income from property, interest and dividends. If the HUF runs a business, GST returns are filed in its name with the karta as authorised signatory.

When members are added or the karta changes, we update documents and bank records and advise on partition and succession questions with the family’s legal counsel.
